Reporting to the Deputy CEO, the Chief Legal Affairs, Enforcement AML/CFT Officer ("Chief LEA Officer”) leads and provides strategic direction to the Director of Legal Affairs and Enforcement, Director of Litigation and Head of AML/CFT Division, and their teams to contribute to the achievement of CIMA’s mandate. The Chief LEA Officer is responsible for ensuring that CIMA’s regulatory and policy framework is in line with the relevant legislation for robust financial services supervision and combating financial crime. The Chief LEA Officer acts in an advisory capacity on all legal matters to ensure that CIMA creates and enforces a regulatory framework that instils confidence and upholds the reputation of the Cayman Islands as a major financial centre.
RESPONSIBILITIES:
The successful candidate will:
• Advise the CEO and Deputy CEO on high level issues relevant to the governance and the reputation of CIMA and also contribute to the development and implementation of CIMA’s strategic objectives;
• Provide strategic direction and guidance to the Director of Legal Affairs and Enforcement, Director of Litigation and the Head of AML/CFT Division (“HOD AMLD”) and divisions under their oversight;
• Serve as a first line of defence in managing risks within assigned area of responsibility, including fostering a culture of risk management within their assigned part of the Authority;
• Provides high level legal advice to the Deputy CEO, CEO and the Board of Directors with respect to developing and implementing regulatory framework and complying with relevant legislative obligations including the matters regarding the functions, duties, powers and responsibilities of CIMA;
• Plan, direct, evaluate and recommend amendments to the legislative framework to ensure CIMA is operating in an effective manner that is consistent with international standards and supervisory best practices;
• Provides advice and directives on litigation matters, alternative dispute resolutions and enforcement matters;
• Ensure that systems are in place for a robust and effective anti-money laundering/counter financing of terrorism/counter proliferation financing/ sanctions (“AML/CFT”) risk-based supervision;
• Ensures that systems are in place to cooperate and coordinate with domestic and foreign authorities for enforcement and intelligence matters;
• Assists in ensuring that CIMA has effective systems in place for data protection and for complying with applicable confidentiality laws;
• Be a positive ambassador at conferences, meetings and events and presents information, bringing back ideas, and making recommendations to improve the regulatory regime and legislative framework;
• Support and provide guidance to Senior Management under his/her oversight to develop and foster leadership, interpersonal, and emotional intelligence skills;
• Ensures that divisions under his/her oversight have systems in place to provide appropriate opportunities for staff training and development;
• In relation to all legal matters, ensures ongoing communication and cooperation with foreign competent authorities, and other appropriate external agencies to develop and achieve shared goals and objectives and to ensure agreements with overseas regulators are honoured.
REQUIREMENTS:
• A solicitor, barrister or attorney-at-law qualified to practice in an English-speaking Commonwealth jurisdiction; and
• Excess of fifteen (15) years relevant PQE, at least five of which should be in a government setting, with specific experience in the practice of administrative law;
• Extensive knowledge of, and experience working in, financial services regulatory practices;
• Extensive knowledge of the regulatory acts of the Cayman Islands;
• Extensive litigation experience;
• Excellent opinion writing abilities;
• Extensive knowledge of relevant international standards regarding financial services supervision and combating financial crime;
• Strong team, leadership and relationship-building skills, with significant experience at a senior management level; and
• Excellent communication, presentation, mediation and negotiating skills.
